1. Who are we?

thimbl. is a registered trading style of Digitonomy Limited, registered in England and Wales (company number 08385135). Our registered office is at: Steam Mill Business Centre, Steam Mill Street, Chester, Cheshire, CH3 5AN. We are a credit broker authorised and regulated by the Financial Conduct Authority (“FCA”), and we are entered on the Financial Services Register under reference number: 690249. We are licenced by the Information Commissioners Office under registration number ZA007309.

2. Your acceptance of these Terms and conditions

By visiting our website and using this service, you are accepting our terms and conditions, privacy policy and cookie policy and agree to abide by them.

If you do not agree to these terms and conditions, you should stop using and/or accessing our website immediately. If you breach any of these terms, your right to access and use our website will cease immediately.

We acknowledge our obligations to this agreement by performing the service you have requested. In doing so, we are the service provider and you are our customer.

We deal directly with you and have no obligation to any party other than you, our customer.

If you are accessing our service on behalf of someone else, our obligation is still with you, the customer. As our customer, the terms and conditions of this agreement apply to you, not with any other parties or agents that may be connected to you.

3. Changes to these Terms and conditions

We reserve the right to amend these terms and conditions from time to time by amending this page. The amended terms and conditions will be effective from the date they are posted on our website.

By continuing to use our website after changes are posted you are accepting our new terms and conditions.

4. thimbl. Products

We provide an online credit broking service and work with Vanquis Bank Limited (“Vanquis Bank”) to provide the thimbl. credit card and the thimbl. loan. You can apply for each of these products through our website.

We do not charge you a fee for using our service, but we do receive commission from Vanquis Bank.

Whether or not Vanquis Bank are able to issue you with a thimbl. product is their responsibility and will depend on factors such as their assessment of your eligibility and credit worthiness by taking into account your credit history.

You are protected under the Consumer Credit Act 1974 (as amended) (“CCA”), and Vanquis Bank are authorised and regulated by the Financial Conduct Authority.

5. Your use of our Website

Our website is for your personal use only and you must not use it in any unlawful or fraudulent manner. You should only use our service if you are a UK resident aged 18 years or over.

If you are using our website on behalf of another person, you are responsible for ensuring that they understand and agree to these terms and conditions. When you provide their information, you are confirming to us that you have their permission to do this.

6. Communications from or on behalf of thimbl.

We may contact you by telephone, SMS, email and post about our similar products and services unless you have told us that you do not want to be contacted in this way. (Please read our privacy policy for more information).

By using our service to apply for a thimbl. product, you will be contacted by Vanquis Bank by telephone, SMS, email, and/ post if they approve your application.

7. Credit checks and References

We carry out a soft search on you when you use our website to apply for a thimbl. product. It does not affect your credit score and will only be visible to you. Carrying out a soft search in this way enables us to check your identity and eligibility for a thimbl. product.

In addition, Vanquis Bank will supply your personal details to credit reference agencies to do a pre-application check of your credit file. Only you will be able to see this check so it won’t impact your credit score.

Credit checks and credit reference agencies can also help prevent fraudulent applications. When you make an application, you agree to Vanquis Bank using your personal information to prevent fraud and to verify your identity. This data may be used by a Credit Reference Agency or Fraud Agency and these agencies may keep a record of your information.

You are responsible for ensuring that the information you provide is true and accurate. Misleading information will be regarded as a breach of our terms and is likely to breach any agreement you enter with Vanquis Bank. Furthermore, misleading information may also result in the instigation of criminal procedures against you.

8. Intellectual Property Rights

We are the owner or the licensee of all intellectual property rights in our website, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our website for your personal reference and you may draw the attention of others to material posted on our website.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video or audio sequences or any graphics separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of material on our website must always be acknowledged.

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law including but not limited to the Financial Services and Markets Act 2000, as amended, ("FSMA") or any conduct of business rules developed pursuant to FSMA.

13. Viruses, Hacking and other Offences

15. Applicable Law and Jurisdiction

These terms and conditions and your access to and use of our website (including any dispute or claim arising out of or in connection with them), shall be governed by and interpreted in accordance with English law.

You agree to submit to the exclusive jurisdiction of the courts of England and Wales in connection with these terms and conditions and your access to and use of our website.

16. General

This agreement is in English and all communications between you and us will be in English.

If any provision of these terms and conditions is found to be unlawful, invalid or unenforceable, that provision shall be deemed deleted from these terms and conditions and shall not affect the validity or enforceability of the remaining terms and conditions.

Our terms and conditions, privacy policy and cookie policy, constitute the entire agreement between you and us relating to your use of our website.

No failure or delay by us in exercising any of our rights under these terms and conditions shall constitute a waiver of that right nor will any single or partial exercise by us of any right preclude any further exercise of any right.
